Do\u011fru bir kez daha galip geldi ve sona yakla\u015f\u0131ld\u0131&#8221;<\/p>\n<p>Mersin Valili\u011fi \u00c7evre ve \u015eehircilik \u0130l M\u00fcd\u00fcrl\u00fc\u011f\u00fc yarg\u0131 karar\u0131na uydu ve Mersin Marina&#8217;daki i\u015f yerlerinin i\u015f yeri a\u00e7ma ve \u00e7al\u0131\u015fma ruhsatlar\u0131 iptal edildi. Yat liman\u0131 olarak olu\u015fturulan ancak Al\u0131\u015fveri\u015f Merkezi\u2019ne d\u00f6n\u00fc\u015fen Mersin Marina hakk\u0131nda mahkeme karar\u0131n\u0131 Mersin Valili\u011fi \u00c7evre ve \u015eehircilik \u0130l M\u00fcd\u00fcrl\u00fc\u011f\u00fc duyurdu.<\/p>\n<p>Mimar Abdullah Y\u0131lmaz bu geli\u015fme sonras\u0131 \u00f6nemli ve \u00e7arp\u0131c\u0131 a\u00e7\u0131klamalarda bulundu.<br \/>\nY\u0131lmaz, gelinen noktada Mersin Yeni\u015fehir Yat Liman\u0131&#8217;nda yap\u0131la\u015fma hakk\u0131n\u0131n y\u00fczde 5\u2019den y\u00fczde 10 \u00e7\u0131kar\u0131lmas\u0131 ile yap\u0131lan t\u00fcm fazla imalatlar ve en \u00e7ok 5.50 y\u00fckseklikten fazla olan t\u00fcm ticari birimlerin mahkeme karar\u0131 do\u011frultusunda y\u0131k\u0131lmas\u0131 gerekti\u011fini s\u00f6yledi.\u00a0<br \/>\nHukuk devletinde de olmas\u0131 gerekenin bu olaca\u011f\u0131n\u0131 vurgulayan Y\u0131lmaz, &#8221;Mimar sadece proje \u00e7izmez. Bir tek ya\u015fad\u0131\u011f\u0131 kente diyet borcu vard\u0131r ve Kentine sahip \u00e7\u0131kar. Liyakat, onur ve haysiyet sahibi Cumhuriyet D\u00f6nemi&#8217;nde yeti\u015fmi\u015f mimar olarak yasalar marinay\u0131, marina yasalar\u0131 tan\u0131m\u0131yor, demi\u015ftim! Do\u011fru bir kez daha galip geldi ve sona yakla\u015f\u0131ld\u0131. T\u00fcm i\u015fyerlerinin ruhsatlar\u0131 iptal edildi.&#8221; \u015feklinde konu\u015ftu.<\/p>\n<p>Anayasa\u2019ya g\u00f6re k\u0131y\u0131lar kamunun kullan\u0131m\u0131na a\u00e7\u0131k ve devletin tasarrufu alt\u0131nda oldu\u011funu vurgulayan Y\u0131lmaz, K\u0131y\u0131 kanunu \u00a0\u2018k\u0131y\u0131da hi\u00e7bir yap\u0131 yap\u0131lamaz, k\u0131y\u0131 halka kapat\u0131lamaz\u2019 der. Bunun tek istisnas\u0131, k\u0131y\u0131dan ba\u015fka yere yap\u0131lamayacak olan binalar, liman, iskele, \u00e7ekek yerleri, marinalar gibi, kanunla nas\u0131l yap\u0131labilecekleri d\u00fczenlenen yap\u0131la\u015fmalard\u0131r. Anayasa\u2019n\u0131n kamu yarar\u0131n\u0131 d\u00fczenleyen 43. maddesine g\u00f6re \u201cK\u0131y\u0131lar, devletin h\u00fck\u00fcm ve tasarrufu alt\u0131ndad\u0131r. Deniz, g\u00f6l ve akarsu k\u0131y\u0131lar\u0131yla, deniz ve g\u00f6llerin k\u0131y\u0131lar\u0131n\u0131 \u00e7evreleyen sahil \u015feritlerinden yararlanmada \u00f6ncelikle kamu yarar\u0131 g\u00f6zetilir. k\u0131y\u0131larla sahil \u015feritlerinin, kullan\u0131l\u0131\u015f ama\u00e7lar\u0131na g\u00f6re derinli\u011fi ve ki\u015filerin bu yerlerden yararlanma imk\u00e2n ve \u015fartlar\u0131 kanunla d\u00fczenlenir.\u201d diyor. Dolay\u0131s\u0131yla, Mersin Yat Liman\u0131&#8217;ndaki ticari ama\u00e7l\u0131 bina yap\u0131la\u015fmas\u0131, Anayasa Ve K\u0131y\u0131 Kanunun \u0130lgili H\u00fck\u00fcmlerine ayk\u0131r\u0131d\u0131r. Marina&#8217;n\u0131n in\u015faat alan\u0131, denizden doldurularak elde edilmi\u015f dolgu alanlar\u0131d\u0131r. Kanuna g\u00f6re dolgu alanlar\u0131nda sabit yap\u0131 yap\u0131lamaz.&#8221; ifadelerini kulland\u0131.<\/p>\n<p>&#8220;Mersin&#8217;in k\u0131y\u0131 kesiminde do\u011fal g\u00f6r\u00fcn\u00fcm yok oldu!&#8221;<\/p>\n<p>Mersin Marina AVM Projesiyle Mersin&#8217;in bu k\u0131y\u0131 kesiminde do\u011fal g\u00f6r\u00fcn\u00fcm\u00fcn yok oldu\u011funu ve \u00a0yerini, sahil \u015feridi boyunca, yat liman\u0131n\u0131n varl\u0131\u011f\u0131n\u0131n dahi hissedilmedi\u011fini ifade eden Mimar Y\u0131lmaz, &#8220;Kentsel tarihi ve do\u011fal dokuya uygun olmayan \u00e7elik, cam, vb. yap\u0131 malzemelerinden m\u00fcte\u015fekkil, estetikten yoksun g\u00f6r\u00fcn\u00fcml\u00fc dev al\u0131\u015fveri\u015f merkezi in\u015fa edilmi\u015ftir. Kent-k\u0131y\u0131 ili\u015fkisi yok olmu\u015f ve insan ile deniz aras\u0131, ba\u015ftan ba\u015fa ticari nitelikli \u00a0binalar kaplanm\u0131\u015ft\u0131r. Sahile eri\u015fim engellenmi\u015f, manzara s\u0131n\u0131rlanm\u0131\u015f, siluet bozulmu\u015ftur. Mersin Marina AVM k\u0131sa s\u00fcrede \u00e7ekim merkezi haline gelmi\u015f ziyaret\u00e7i say\u0131s\u0131 da kat kat artm\u0131\u015f, b\u00f6lgede hali haz\u0131rda yetmeyen ula\u015f\u0131m altyap\u0131s\u0131 durma noktas\u0131na gelmi\u015ftir. Elektrik, su, kanalizasyon alt yap\u0131s\u0131 da Mersine ciddi y\u00fckler getirmi\u015ftir. Projenin uygulanmas\u0131 sonras\u0131nda, AVM fonksiyonu \u00f6n plana \u00e7\u0131kt\u0131\u011f\u0131 i\u00e7in b\u00f6lgenin hem ula\u015f\u0131m altyap\u0131s\u0131n\u0131n hem de elektrik, su ve kanalizasyon olarak teknik altyap\u0131s\u0131n\u0131n bu yat\u0131r\u0131m\u0131 kald\u0131racak kapasitede olmamas\u0131 nedeniyle, yeniden elden ge\u00e7irilmesi gerekecek ve bu i\u015fleminde belediye veya kamu eliyle ger\u00e7ekle\u015ftirilecek olmas\u0131 nedeniyle, maliyetinin kamuya y\u00fcklenece\u011fi dolay\u0131s\u0131yla yat\u0131r\u0131mc\u0131 asl\u0131nda halk\u0131n paras\u0131 ile desteklenmi\u015ftir.&#8221; dedi.<\/p>\n<p>Mimar Abdullah Y\u0131lmaz Mersin Marina Yat Liman\u0131&#8217;n\u0131n yap\u0131m a\u015famalar\u0131n\u0131 ve \u00f6zelliklerini s\u0131ralad\u0131;<br \/>\n1993 y\u0131l\u0131nda 110 milyar dolar ile ihale edilen, temeli 1994 y\u0131l\u0131nda at\u0131lan, 500 yat ba\u011flama, 320 yat karaya alma kapasitesiyle Do\u011fu Akdeniz&#8217;in en b\u00fcy\u00fck yat liman\u0131 &#8216;2009 Y\u0131l\u0131 Yat\u0131r\u0131m Program\u0131&#8217;nda yer alm\u0131\u015f, Mersin Yat Liman\u0131 ile ilgili olarak \u00fcst yap\u0131 in\u015faat\u0131, &#8216;yap-i\u015flet-devret modeli&#8217; ile ihaleye \u00e7\u0131kart\u0131lm\u0131\u015f, 2009\/A\u011fustos ay\u0131nda b\u00f6lge m\u00fcd\u00fcrl\u00fc\u011f\u00fc taraf\u0131ndan y\u00fcklenici firmaya devredilmi\u015ftir. Liman\u0131n, 25 y\u0131ll\u0131\u011f\u0131na s\u00f6z konusu firmaya kiralanm\u0131\u015f , projeyle birlikte limanda 6 milyon 137 bin 307 dolarl\u0131k bir yat\u0131r\u0131m\u0131n ger\u00e7ekle\u015fmesi \u00f6ng\u00f6r\u00fclm\u00fc\u015ft\u00fcr .<br \/>\nMersin Yat Liman\u0131&#8217;n\u0131n y\u0131ll\u0131k kullan\u0131m bedeli ise 102 bin 380 TL&#8217;dir.\u00a0<\/p>\n<p>MERS\u0130N YAT L\u0130MANI MAR\u0130NA&#8217;NIN PROJES\u0130NDE \u0130HALE\u00a0<br \/>\nA\u015eAMASINDAK\u0130 \u00a0\u00d6ZELL\u0130KLER\u0130;<\/p>\n<p>&#8220;Ana dalgak\u0131ran boyu: 1140 metre\u00a0<br \/>\nTali dalgak\u0131ran boyu: 265 metre\u00a0<br \/>\nToplam \u0130skele ve R\u0131ht\u0131m Yana\u015fma Yeri Uzunlu\u011fu: 2 bin 500 metre\u00a0<br \/>\nKorunmu\u015f su alan\u0131: 160 bin metrekare\u00a0<br \/>\nFener kulesi: 2 adet\u00a0<br \/>\nMarina geri saha alan\u0131: 145 bin metrekare\u00a0<br \/>\nMarina kapasitesi: 500 yat.&#8221; \u00a0proje bu temalar \u00fczerine tasarlanm\u0131\u015ft\u0131r.<\/p>\n<p>&#8220;AVM imaj\u0131 \u00f6n plana \u00e7\u0131kt\u0131 Yat liman\u0131 fonksiyonu geri planda kald\u0131&#8221;<\/p>\n<p>Mersin Marina Yat Liman\u0131 2011 y\u0131l\u0131nda i\u015fletmeye a\u00e7\u0131ld\u0131\u011f\u0131n\u0131 ve Yat liman\u0131 ile ilgili in\u015faat ruhsatlar\u0131 2010 y\u0131l\u0131nda Yeni\u015fehir Belediyesi&#8217;nce d\u00fczenlendi\u011finin ancak Yeni\u015fehir Belediyesi k\u0131y\u0131 mevzuat\u0131 kapsam\u0131nda ruhsat d\u00fczenlemeyle ilgili yetkinin \u00c7evre ve \u015eehircilik \u0130l M\u00fcd\u00fcrl\u00fc\u011f\u00fc&#8217;nde olmas\u0131 gerekti\u011fi d\u00fc\u015f\u00fcncesiyle verilen ruhsatlar\u0131 2011 y\u0131l\u0131nda iptal etti\u011finin alt\u0131n\u0131 \u00e7izen Y\u0131lmaz, &#8220;Bu tarihten 2016 y\u0131l\u0131na kadar iptal edilen ruhsatlar\u0131n hangi kurum taraf\u0131ndan verildi\u011fi bilinmemektedir. Bilinen Mersin \u00c7evre ve \u015eehircilik \u0130 M\u00fcd\u00fcrl\u00fc\u011f\u00fc&#8217;nce Yat Liman\u0131&#8217;n\u0131n Ticari alanlar\u0131n\u0131n artmas\u0131 ana temal\u0131, b,c,d,e,f,g,h,\u0131 ve j bloklar\u0131 i\u00e7in 05\/05\/2016 tarih ve 2016\/1-2 say\u0131l\u0131 tadilat yap\u0131 ruhsatlar\u0131n\u0131n d\u00fczenlendi\u011fi,ayn\u0131 bloklar i\u00e7in 06\/05\/2016 tarih ve 2016\/1-2 say\u0131l\u0131 yap\u0131 kullanma izin belgesi d\u00fczenlendi\u011fidir. Yat liman\u0131n\u0131n amac\u0131n\u0131n d\u0131\u015f\u0131nda al\u0131\u015fveri\u015f merkezine tam d\u00f6n\u00fc\u015ft\u00fcr\u00fclmesi i\u00e7in ilave in\u015faatlar\u0131n yap\u0131m s\u00fcrecinde, Mersinde duyarl\u0131 bir vatanda\u015f\u0131m\u0131z taraf\u0131ndan Dan\u0131\u015ftay 1. Dairesine, in\u015fa edilen yat liman\u0131 in\u015faas\u0131n\u0131n eksik ve ayk\u0131r\u0131l\u0131klar\u0131na, \u00fcst yap\u0131 \u00e7al\u0131\u015fmalar\u0131n\u0131n 3194 say\u0131l\u0131 imar kanunu ve 3621\/3830 say\u0131l\u0131 k\u0131y\u0131 kanunu ve bu kanun \u00f6ncesi i\u00e7in ge\u00e7erli y\u00f6netmelikler esas al\u0131narak,marina avm yap\u0131la\u015fmas\u0131na, bakanl\u0131k nezdinde \u015fikayette bulunmu\u015f ve baz\u0131 g\u00f6revliler hakk\u0131nda su\u00e7 duyurusunda, bulunulmu\u015ftur. Dan\u0131\u015ftay 1. Dairesi, \u015fikayete ili\u015fkin a\u00e7\u0131klad\u0131\u011f\u0131 kararda; Mersin Yat Liman\u0131 \u0130n\u015faat\u0131&#8217;n\u0131n projesine uygun olup olmad\u0131\u011f\u0131 konusunda bilirki\u015fi incelemesi yap\u0131ld\u0131\u011f\u0131n\u0131, bilir ki\u015filerce d\u00fczenlenen raporda, \u00fcst yap\u0131 projesinde, \u00f6ncelikle Mersin B\u00fcy\u00fck\u015fehir Belediyesi \u0130mar Y\u00f6netmeli\u011fi&#8217;nin h\u00fck\u00fcmlerine ayk\u0131r\u0131 olarak ticari alan tan\u0131m\u0131na giren yerlerin ticari olmayan alanlar olarak g\u00f6sterildi\u011fi, asma katlar\u0131n tan\u0131mlamaya uymad\u0131\u011f\u0131, s\u00f6z konusu projede 2.037,86 m2 ticari alan belirtilmesine ra\u011fmen alan\u0131n tamam\u0131n\u0131n y\u00fczde 1 olan ticari alan hesab\u0131n\u0131n a\u015f\u0131ld\u0131\u011f\u0131, \u00a0projeye ayk\u0131r\u0131 olarak kazan\u0131lan asma kat ve birinci katlar\u0131n projeye ayk\u0131r\u0131 olarak kazan\u0131ld\u0131\u011f\u0131, ayr\u0131ca avan projeden sonra 2011 tarihinde revize edilen projenin mersin b\u00fcy\u00fck\u015fehir belediyesi imar y\u00f6netmeli\u011fine ve planl\u0131 alanlar maddelerine de ayk\u0131r\u0131 oldu\u011fu, ayn\u0131 zamanda onayl\u0131 projeye ayk\u0131r\u0131 kullan\u0131m ve imalat\u0131n bulundu\u011fu, ticari alan hesab\u0131n\u0131n yanl\u0131\u015f oldu\u011fu \u00a0g\u00f6r\u00fc\u015flerine yer verilmi\u015ftir. Dan\u0131\u015ftay\u2019\u0131n bilirki\u015filerinin tuttu\u011fu rapor sonras\u0131nda, \u00c7evre ve \u015eehircilik Bakanl\u0131\u011f\u0131&#8217;ndaki teknik g\u00f6revlilere de Mersin Yat Liman\u0131 hakk\u0131nda inceleme raporu d\u00fczenlemesini istemi\u015ftir. Bu raporda da yat liman\u0131ndaki yap\u0131lar\u0131n her ne kadar k\u0131y\u0131 kanununda yer almasa da deniz turizm y\u00f6netmeli\u011fi a\u00e7\u0131s\u0131ndan uygun oldu\u011fu, fakat ticari alan olarak kullan\u0131lan alan\u0131n projeye g\u00f6re fazla oldu\u011fu g\u00f6r\u00fc\u015flerine yer verilmi\u015ftir. \u0130ki farkl\u0131 bilirki\u015fi raporunu inceleyen Ula\u015ft\u0131rma Bakanl\u0131\u011f\u0131, iki rapor aras\u0131ndaki \u00e7eli\u015fkileri gerek\u00e7e g\u00f6stererek, \u2018g\u00f6revi k\u00f6t\u00fcye kullanmakla\u2019 su\u00e7lanan 2 b\u00fcrokrat ve 16 personel hakkinda soru\u015fturmaya izin vermemi\u015ftir. Bunun \u00fczerine \u015fik\u00e2yet\u00e7i vatanda\u015f, Ula\u015ft\u0131rma Bakanl\u0131\u011f\u0131\u2019n\u0131n bu kararina karsi Dan\u0131\u015ftay nezdinde tekrar dava a\u00e7m\u0131\u015ft\u0131r. Davay\u0131 g\u00f6r\u00fc\u015fen Dan\u0131\u015ftay 1. dairesi, 7 aralik 2011 tarihli karar\u0131nda, iki bakanl\u0131\u011f\u0131n iki bilirki\u015fi heyeti taraf\u0131ndan haz\u0131rlanan raporlarda, yat liman\u0131 \u00fcst yap\u0131 in\u015faat\u0131n\u0131n k\u0131y\u0131 ve imar mevzuatina ayk\u0131r\u0131l\u0131\u011f\u0131n\u0131n dile getirildi\u011fini, iki rapor arasinda ciddi \u00e7eli\u015fki olmad\u0131\u011f\u0131n\u0131 belirtmi\u015f ve soru\u015fturmaya izin verilmesi gerekti\u011fine h\u00fckmetmi\u015ftir. Dan\u0131\u015ftay 1. dairesi, 7 aral\u0131k 2011 tarihinde her iki inceleme sonras\u0131nda 2011\/ 1806 esas no ve 2011\/1978 karar no ba\u015fl\u0131\u011f\u0131nda karar\u0131n\u0131 vererek her iki kararda da ciddi say\u0131labilecek \u00e7eli\u015fkiler bulunmad\u0131\u011f\u0131n\u0131, yat liman\u0131 in\u015faat\u0131n\u0131n projesine ve k\u0131y\u0131 mevzuat\u0131na ayk\u0131r\u0131 yap\u0131ld\u0131\u011f\u0131 tespitine yer verildi\u011fi gerek\u00e7esiyle, avan ve revize uygulama projelerinde imzalar\u0131 bulunan ve i\u015fin kontroll\u00fck hizmetini y\u00fcr\u00fcten Adana Ula\u015ft\u0131rma B\u00f6lge M\u00fcd\u00fcrl\u00fc\u011f\u00fc Proje Kontroll\u00fck B\u00f6l\u00fcm\u00fc&#8217;nde imzalar\u0131 bulunan Ula\u015ft\u0131rma Bakanl\u0131\u011f\u0131&#8217;nda, projeye onay veren Hava Meydanlar\u0131 Yap\u0131m Daire Ba\u015fkan\u0131, Hava Meydanlar\u0131 Et\u00fcd Projesi Daire Ba\u015fkan\u0131, Ula\u015ft\u0131rma Bakanl\u0131\u011f\u0131, DLH \u0130n\u015faat\u0131 Genel M\u00fcd\u00fcr Yard\u0131mc\u0131s\u0131, s\u00f6zle\u015fmesine uygun olarak bitirilmeyen in\u015faat\u0131n kabul y\u00f6n\u00fcnde onaylanmas\u0131n\u0131 uygun g\u00f6ren kabul heyeti g\u00f6revlileri hakk\u0131nda soru\u015fturma izni vererek dosyan\u0131n Ankara Cumhuriyet Ba\u015fsavc\u0131l\u0131\u011f\u0131&#8217;na g\u00f6nderilmesine oybirli\u011fi ile karar vermi\u015ftir. Daire, \u015fik\u00e2yete konu olan 5 teknik personeli ise \u2018sorumlu\u2019 olmad\u0131klar\u0131 gerek\u00e7esiyle soru\u015fturma kapsamI d\u0131\u015f\u0131nda tutmu\u015ftur. Ankara Cumhuriyet Ba\u015fsavc\u0131l\u0131\u011f\u0131&#8217;nca A\u011f\u0131r Ceza Mahkemesi&#8217;nde dava a\u00e7\u0131lm\u0131\u015ft\u0131r. i\u00e7inde bulundu\u011fumuz bu d\u00f6nem i\u00e7erisinde de yat liman sahas\u0131 i\u00e7erisinde mevcut ticari alan m2&#8217;si 2018-2019 seneler i\u00e7inde ilave edilen yeni in\u015faatlarla, al\u0131\u015fveri\u015f alanlar\u0131 ile artt\u0131r\u0131larak ticari alan oran\u0131, y\u00f6netmelikler hi\u00e7e say\u0131larak artt\u0131r\u0131lm\u0131\u015ft\u0131r. \u00a0Projede olmas\u0131 gereken ticari alanlar ve donat\u0131 alanlar\u0131 i\u00e7in ayr\u0131lan, otoparklar, bir k\u0131sm\u0131da \u00fccretli olarak ticari ama\u00e7la kulland\u0131r\u0131larak yeni yap\u0131lan ma\u011faza in\u015faatlar\u0131 ,ticari alanlarda artt\u0131rd\u0131\u011f\u0131 i\u00e7in tesis i\u00e7in mevcut otoparklar yetersiz, kalm\u0131\u015f, Adnan Menderes Bulvar\u0131 \u00fczeri bu tesisin otopark\u0131 gibi kullan\u0131l\u0131r hale gelmi\u015f trafik kilitlenmi\u015ftir. AVM imaj\u0131 \u00f6n plana \u00e7\u0131km\u0131\u015f, yat liman\u0131 fonksiyonu geri planda kalm\u0131\u015ft\u0131r. Bu durum kentin bu b\u00f6l\u00fcm\u00fcne \u00e7ok fazla bir trafik y\u00fck\u00fc getirmi\u015f, \u00f6zellikle hafta sonlar\u0131, amac\u0131 sadece ticariye d\u00f6n\u00fck fonksiyonlar y\u00fcklendi\u011fi i\u00e7in,ana arter t\u0131kanmakta trafik akamaz hale gelmektedir. Ne ama\u00e7la kullan\u0131laca\u011f\u0131 belli olmayan, \u00e7ekme mesafeleri i\u00e7erisine kapal\u0131 in\u015faat alanlar\u0131 yap\u0131lm\u0131\u015ft\u0131r, bu yap\u0131lar y\u00f6netmeliklere tamami ile ayk\u0131r\u0131d\u0131r.&#8221; \u015feklinde konu\u015ftu.<\/p>\n<p>Yat liman\u0131 nas\u0131l AVM&#8217;ye d\u00f6n\u00fc\u015ft\u00fc!<\/p>\n<p>\u00c7evre ve \u015eehircilik Bakanl\u0131\u011f\u0131&#8217;nca \u201cK\u0131y\u0131 kanunu&#8217;nun uygulanmas\u0131na dair y\u00f6netmelik\u201dte 02.04.2013 tarih ve 28606 say\u0131l\u0131 resmi gazete ile baz\u0131 de\u011fi\u015fiklikler yap\u0131ld\u0131\u011f\u0131n\u0131 yap\u0131lan de\u011fi\u015fiklikler aras\u0131nda yat limanlar\u0131nda konaklamaya imkan sa\u011flayacak d\u00fczenlemelerin de yer almakta oldu\u011fun s\u00f6yleyen Y\u0131lmaz. \u0130lgili d\u00fczenlemenin, yat liman\u0131, yatlara g\u00fcvenli bir ba\u011flama ve her yata do\u011frudan y\u00fcr\u00fcyerek \u00e7\u0131k\u0131lmas\u0131na imk\u00e2n sa\u011flayan, yeterli derinlikte su bulunan ve yatlara teknik ve sosyal altyap\u0131, y\u00f6netim, destek, konaklama, bak\u0131m ve onar\u0131m hizmetlerini sunan, r\u00fczg\u00e2r ve deniz tesirlerinden korunmu\u015f, i\u015fletme izin belgesi alm\u0131\u015f, turizm i\u015fletmesi belgeli k\u0131y\u0131 yap\u0131lar\u0131 oldu\u011funu ifade etti. Yat limanlar\u0131nda konaklama tesisi yap\u0131lmas\u0131 halinde, bu tesislerin y\u00fckseklikleri 6.50 metreyi (2 kat) ve emsali toplam emsalin y\u00fczde 20\u2019sini ge\u00e7meyecek \u015fekilde yap\u0131la\u015fma ko\u015fullar\u0131 imar plan\u0131 karar\u0131 ile belirlenece\u011fi bilgisini veren Mimar Y\u0131lmaz, &#8220;Yat limanlar\u0131nda t\u00fcm \u00fcst yap\u0131larda kot, her binan\u0131n k\u00f6\u015fe kotlar\u0131n\u0131n aritmetik ortalamas\u0131 al\u0131narak bulunur. bodrum katlar yap\u0131 y\u00fcksekli\u011fine ve emsale d\u00e2hildir.\u2018\u2019 \u015feklinde. \u00c7evre ve \u015eehircilik Bakanl\u0131\u011f\u0131&#8217;nca onaylanan yat liman\u0131n\u0131 da kapsayan alanda en son onaylad\u0131\u011f\u0131 dolgu ama\u00e7l\u0131 1\/5000 \u00f6l\u00e7ekli naz\u0131m ve 1\/1000 \u00f6l\u00e7ekli uygulama \u00a0imar planlari olmas\u0131na kar\u015f\u0131n, planlar\u0131nda kademelenme ilkesine ve yine kiyi kanununun uygulama y\u00f6netmeli\u011finde yap\u0131lan de\u011fi\u015fikli\u011fe ayk\u0131r\u0131 bir bi\u00e7imde yat liman\u0131na ili\u015fkin \u00f6zel h\u00fck\u00fcmler ba\u015fl\u0131\u011f\u0131 alt\u0131nda onayl\u0131 hem nazim imar hemde uygulama imar plan\u0131n\u0131n da ayni h\u00fck\u00fcmler bulunmas\u0131na kar\u015f\u0131n 2013 y\u0131l\u0131nda bakanl\u0131k oluru ile onaylanan 1\/1000 \u00f6l\u00e7ekli uygulama imar plan\u0131nda plan notu de\u011fi\u015fikli\u011fine gitmek suretiyle mevzuata ayk\u0131r\u0131 i\u015flem yapm\u0131\u015ft\u0131r.&#8221; dedi.<\/p>\n<p>Y\u0131lmaz \u015f\u00f6yle devam etti;<br \/>\n&#8220;Plan notu de\u011fi\u015fikli\u011fi \u00f6ncesi onayl\u0131 1\/5000 \u00f6l\u00e7ekli naz\u0131m 1\/1000 \u00f6l\u00e7ekli k\u0131y\u0131 dolgu ama\u00e7l\u0131 uygulama imar plan\u0131nda \u00f6zel h\u00fck\u00fcmler ba\u015fl\u0131\u011f\u0131 alt\u0131nda yat limani\u2019na ili\u015fkin plan notu\u2019nun 1.2. maddesinde; 1.2. k\u0131y\u0131 kanununun uygulanmas\u0131na dair y\u00f6netmeli\u011fin baz\u0131 maddelerinin de\u011fi\u015ftirilmesi hakk\u0131nda 27.07.1986 tarihinde 22709 say\u0131l\u0131 resmi gazete&#8217;de yay\u0131mlanan y\u00f6netmelik ile de\u011fi\u015fik 4. maddesinde tan\u0131mlanan y\u00f6netim birimleri, destek birimleri bakim-onarim ve teknik sosyal altyapinin i\u00e7ine giren yapi tesisler d\u0131\u015f\u0131nda herhangi bir yap\u0131la\u015fmaya izin verilmeyecektir. bu tesislere ait toplam emsal yat limaninin doldurma ve kurutma yoluyla kazanilan arazilerin y\u00fczde 5\u2019ini ge\u00e7emez. Y\u00fckseklik h=4.50 metreyi, asma katli yap\u0131lmas\u0131 halinde h=5.50 metreyi a\u015famaz. h\u00fckm\u00fc bulunmaktaydi. Mevzuata ayk\u0131r\u0131 bakanl\u0131k\u00e7a onaylanan 1\/1000 \u00f6l\u00e7ekli plan paftas\u0131nda plan notu de\u011fi\u015fikli\u011fi yap\u0131lmak suretiyle d\u00fczenlenen yat limanina ili\u015fkin plan notu\u2019nun 1.2. maddesinin yeni hali, 1.2.yat liman\u0131 olarak tan\u0131ml\u0131 alanda;<br \/>\na)\u201d3621 say\u0131l\u0131 k\u0131y\u0131 kanunu\u201d ve \u201ck\u0131y\u0131 kanununun uygulanmas\u0131na dair y\u00f6netmelik\u201d , \u201cturizm tesislerinin belgelendirilmesi ve niteliklerine ili\u015fkin y\u00f6netmelik\u201d ve \u201c5561 say\u0131l\u0131 deniz turizmi y\u00f6netmeli\u011fi\u201dnin yat liman\u0131yla ilgili maddelerinde belirtilen yapi ve tesisler yapilabilir.\u00a0<br \/>\nyat limaninda toplam emsal-kaks = 0.10, maksimum y\u00fckseklik (2) kat, hmax=6,50 m\u2019yi ge\u00e7emez. asma kat yapilabilir. konaklama tesisi yap\u0131lmas\u0131 halinde, bu tesislerin y\u00fckseklikleri 6.50 metreyi (2 kat) ve emsali toplam emsalin %20\u2019sini ge\u00e7emez. yat limanlarinda t\u00fcm \u00fcst yap\u0131larda kot, her binanin k\u00f6\u015fe kotlar\u0131n\u0131n aritmetik ortalamasi alinarak bulunur. bodrum katlar yap\u0131 y\u00fcksekli\u011fine ve emsale d\u00e2hildir. Y\u00f6netmelikte\u2019&#8217;te yapilan sadece konaklama tesisi yap\u0131lmas\u0131n\u0131n \u00f6n\u00fcn\u00fc a\u00e7an de\u011fi\u015fiklikler bahane edilmek suretiyle yat liman\u0131nda plan notu de\u011fi\u015fikli\u011fi marifetiyle; de\u011fi\u015fiklik \u00f6ncesi onayli naz\u0131m ve uygulama imar plan\u0131na ait plan h\u00fck\u00fcmlerinde; bu tesislere ait toplam emsal yat limaninin doldurma ve kurutma yoluyla kazanilan arazilerin y\u00fczde 5\u2019ini ge\u00e7emez iken, de\u011fi\u015fiklik sonras\u0131 k\u0131y\u0131 kanununun uygulanmas\u0131na dair y\u00f6netmelikte yap\u0131lan de\u011fi\u015fikli\u011fi amac\u0131ndan sapt\u0131rmak suretiyle yat liman\u0131nda toplam emsal-kaks=0.10\u2019a y\u00fckseltilmi\u015ftir.bir ba\u015fka ifade ile emsal y\u00fczde y\u00fcz oran\u0131nda art\u0131r\u0131lm\u0131\u015ft\u0131r. Yat limanlar\u0131nda konaklama tesisi yap\u0131lmas\u0131na y\u00f6nelik yukarda alintisi yapilan \u2019\u2019kiyi kanununun uygulanmasina dair yat limanlarinda toplam emsalin y\u00fczde 20\u2019sini ge\u00e7meyecek bi\u00e7imde konaklama tesisi yap\u0131lmas\u0131na izin verilmesine ra\u011fmen plan notu de\u011fi\u015fikli\u011fi bahane edilerek \u00a0toplam emsal y\u00fczde 100 oran\u0131nda art\u0131r\u0131lm\u0131\u015ft\u0131r. Plan m\u00fcellifi ve plan\u0131 onaylayan bakanl\u0131k bununla da yetinmeyerek plan de\u011fi\u015fikli\u011fi \u00f6ncesi yat limanlarinda doldurma ve kurutma yoluyla kazanilan arazilerin y\u00fczde 5\u2019i ile s\u0131n\u0131fland\u0131r\u0131l\u0131rken, plan de\u011fi\u015fikli\u011fi neticesinde doldurma ve kurutma yoluyla kazan\u0131lan arazi ibaresi bilin\u00e7li olarak kullan\u0131lmayarak sadece yat limani ibaresi kullanilarak plan onama sinirini kapsayacak bi\u00e7imde \u00f6nce emsal hesab\u0131na dahil edilen alan art\u0131r\u0131lm\u0131\u015f, art\u0131r\u0131lan alaninda y\u00fczde10\u2019u denilmek suretiyle toplam emsal alan hesabinda \u00a0ger\u00e7ekte y\u00fczde 100\u2019den \u00a0\u00e7ok daha fazla art\u0131\u015f sa\u011flanm\u0131\u015ft\u0131r. (Yine plan notu de\u011fi\u015fikli\u011fi \u00f6ncesi \u00a0yap\u0131lacak tesislerde y\u00fckseklik h=4.50 metreyi , asma katli yap\u0131lmas\u0131 halinde h=5.50 metreyi ge\u00e7emez iken,de\u011fi\u015fiklik sonrasi yapilacak t\u00fcm tesislerde maksimum y\u00fckseklik 6.50 metreye (2kat\u2019a)y\u00fckseltilmi\u015ftir.(dikkat edilecek olursa y\u00f6netmelik de\u011fi\u015fikli\u011finde sadece konaklama tesislerine y\u00f6nelik 2 kat 6.50 metre y\u00fckseklik olana\u011f\u0131 getirilirken,plan notu de\u011fi\u015fikli\u011fi ile yat limaninda yapilacak t\u00fcm tesisleri kapsayacak \u00a0bi\u00e7imde y\u00fckseklik 6.50 metreye y\u00fckseltilmi\u015ftir.)<br \/>\nKar\u015f\u0131la\u015ft\u0131rmal\u0131 olarak irdeledi\u011fimiz plan notu de\u011fi\u015fikli\u011fi \u00f6ncesi ile plan notu de\u011fi\u015fikli\u011fi sonras\u0131 yap\u0131lan i\u015flemlere bakildi\u011finda s\u00f6z konusu plana ait plan a\u00e7\u0131klama raporunda yer alan plan notu de\u011fi\u015fikli\u011fine ili\u015fkin gerek\u00e7ede iddia edildi\u011fi gibi yap\u0131lan i\u015flemlerin 2013 y\u0131l\u0131nda \u00a0\u00c7evre ve \u015eehircilik Bakanl\u0131\u011f\u0131&#8217;nca yat limanlarinda konaklama tesisi yap\u0131lmas\u0131 \u00a0y\u00f6n\u00fcnde \u2018\u2019kiyi kanununun uygulanmasina dair y\u00f6netmelikte \u2018\u2019yapilan de\u011fi\u015fiklikler \u00e7er\u00e7evesinde yapilmadi\u011fi, aksine bahis konusu y\u00f6netmelik de\u011fi\u015fikli\u011fi bahane edilerek \u00a0yat limaninda yap\u0131lan ve yap\u0131lacak tesislere y\u00f6nelik emsal in\u015faat alaninin artirildi\u011fi a\u00e7iktir. Nitekim plan notu de\u011fi\u015fikli\u011fi sonrasi, bu de\u011fi\u015fikli\u011fe dayan\u0131larak Mersin \u00c7evre ve \u015eehircilik \u0130l M\u00fcd\u00fcrl\u00fc\u011f\u00fc&#8217;nden \u00e7e\u015fitli tarihlerde al\u0131nan \u00a0ilave tadilat ruhsatlar\u0131 marifetiyle h\u0131zl\u0131 bi\u00e7imde yat limani, yat limani \u00a0olmaktan \u00e7\u0131kar\u0131larak kiyi mevzuatina ayk\u0131r\u0131 bi\u00e7imde k\u0131y\u0131 kenar \u00e7izgisi alt\u0131nda faaliyette bulunan al\u0131\u015fveri\u015f merkezine d\u00f6n\u00fc\u015fm\u00fc\u015ft\u00fcr.&#8221;<\/p>\n<p>M\u00fcd\u00fcrl\u00fck son noktay\u0131 koydu!<\/p>\n<p>YIlmaz, Mersin yat liman\u0131&#8217;n\u0131n dev bir AVM&#8217;nin s\u00fcs havuzu oldu\u011funu s\u00f6yledi.
